People have been thinking that all along and have been lying motionless like a crocodile doing sunbath. USCIS have been retrogressing the Visas and at the same time consistently wasting Visa numbers every years. Shouldn't they have already been sued for that. We'll not do anything today just because it take 2-3 years. But what if they screw us again after 2-3 years. Dodn't you think we should keep fighting for injustice even if the benifit may not come to our generation but should pass to coming generation. If every body will become so much short sighted nobody would care for global warming, alternative eneryg options etc...
The suit is long over due. If we do not do it, they will never learn the lesson and they will continue screw not only us, but the future generation again and again. I wish the previous generation had done that for them as well as for us, and we would not have been in such a pathetic situation. :mad:

I disagree.
Why is it not easy to change from EB3 to EB2?
We have to decide what is important in life for us. Current job/salary/promotion/ status quo or Geeencard?
If someone wants EB2, they can change their job and apply again. The law does not prohibit that. So stop blaming unfair laws.
So the only reason why a lot of us are in EB3 is becasue we have chosen to stay with the current employer who pays us well and do not want to take the risk of a new employer. So it is our choice and not injustice. The system allows us options. We cannot want a cake and eat it too. I am also trying to find a new employer to change my job and file in EB2. Everyone is free to do that.
And stop claiming that you are fit for EB2 but are stuck in EB3. If you are fit for EB2 then why don't you apply in EB2? If you have a masters degree you can find a new job with EB2 that needs a masters degree. Anyone who does not have masters degree then get work experience and change your job to file in EB2. Ultimately we have to decide what we want.

Just because the system provides 100 loopholes/opportunities/possibilities, does not mean one has to explore everything to get justice from the system. As I said, not EVERYONE can do that. It is indeed sad that you continue to pontificate from a perch of indifference and ignorance. We all know that the entire EB immigration system is not a zero sum game (just ask Ron Hira and his ilk). Sad thing is, when it comes to EB3 I's, EB 2's such as you suddenly transform into a Ron Hira lite ... going about throwing broad hints about how the system is setup the way it is ... to serve those 'higher in the pecking order'.
If we were to buy this weak attempt at making a 'logical point', I would be glad to give Ron a call and have his folks look into YOUR respective EB2 applications and find out if there REALLY was "NO" qualified US worker available for that job. Want to play that game?

I am really surprised that you guys are contemplating on going against your employer for a employment letter and filing your GC. I mean, how hard is it for you guys to agree to the terms of your employer that you will work till you get your GC and upto 6 months beyond that..

If you live in MA, go to http://kennedy.senate.gov/ and select 'case work' from Constituents Services. If you live in another state, go to your state's senator's website and find link to send them request related to cases pending with gov. agencies.
BTW - I received physical EAD cards with two year validity in mail on 9/11

I do agree severely retrogressed folks do need some concessions and I appreciate guys like Sanhari highlighting this issue. I think we should mobilize the opinion and assert it in a positive way. IV core members have a lot of experience in dealing with the DC system and USCIS let us take advantage of this so that we are not reinventing the wheel.

I filed my I-129 for H1B extension in March, 2008. It is almost 5 months. I haven't got my H1B extension approval yet.
Do any of you experience delay in H1B extension? Is it normal waiting time after July 2007 fiasco?

AS for GC, I have a coworker whose dad, the primary applicant , passed away, and only 1 dependent was able to continue process and just recently got his GC. Most likely, your wife will not be forced to return home.

Did anyone get their physical Cards without getting CPO message ?
I have recd the I-797C Approval notice on the 11th but I have not recd the physical cards as yet. BTW I did not get any welcome e-mail or CPO mail - I directly got 485 Approval e-mail and that is all.
Did you receive teh physical cards by now?

Answer to question 1: Yes you can, but make sure that at least on paper the job responsibilities remain the same as the job for which your present employer sponsored your GC. The designation can be anything.
Answer to question 2: USCIS is not very clear on the percentage increase/decrease in salary that a person should draw in a new job from the job which sponsored the GC. However, it says, that there should not be a huge disparity between the two. Looking at the figures that you provided, it looks like a huge disparity. I am pretty sure that the "bonus" in your first job was not accounted for in the salary which was mentioned in the LC by your sponsor. Even if they did, the difference seems to be huge. If it is possible, ask the BIG employer to offer you the same amount of 65K as salary and the rest as "bonus".

Can I accept the 'offer' based on the above points and use my EAD?
Or is it a violation of AOS rules?

I really don't understand these Attorneys. Its clearly mentioned on 485 form that ALL 485 petitions should go to NSC. period.
And as far as I know, due to awareness and the fact we all are professionals who can go to USCIS site and read the instructions in black and white, we should not just rely on this morons (attorneys.. though there are some good ones around)
If you read http://www.uscis.gov/files/pressrelease/BiSpec_063006FS.pdf, you'll see that there is a line on page 2 that specifically says "Until further notice, USCIS will not reject applications or petitions filed at an incorrect Service Center. Instead, USCIS will accept the filing, redirect it to the correct location, and honor the initial receipt date."
So if you already know that your I-485 will be adjudicated by the service center where your I-140 was processed, you just save some processing time by sending it there. See also Matthew Oh's May 14, 2007 post in which he says that USCIS may try to accelerate bi-specialization phase III in order to avoid sending massive numbers of files from the central NSC location to the locations where the I-140 processing was done.

My I-485 was mailed on June 1'st. Attorney haven't received receipts yet.
But my checks to USCIS got cashed yesterday. There are two numbers starting with SRC......but I dont know why there are two numbers instead of one.
